I have the honour to report for Your Lord- ship's information that the legality of the control which was exercised by this Government during the war over ships registered in Hongkong and Shanghai is being celled in question by means of a test action which has been brought by the Wollowre Steamship Company, Ltd. on the grounds set but in the enclosed Statement of Claim,

I attach in duplicate copies of correspon-

dence pertinent to the matter. Under the authority conveyed in Mr. Long's telegram of the 12th May, 1917, ✡ Shipping Board was constituted, and on their advice the 8.8. "Hollowra" was selected for the purpose of bringing coal to the Colony and was requisitioned by the Commodore at the request of this Government. The vessel was put under the management of Messrs. Dodwell & Company, the local agents of the Kailan Mining Administration, who were supplying the coal. Subsequently, when the Hongkong Government's Control Scheme was instituted, the vessel was brought under that scheme and its management was placed in the hands of Messrs. Moller and Company, agents for the

owners.

The plaintiffs in the present action and the other shipowners who are behind them do not appear to be anxious, for the time being at any rate, to proceed with
